Statutory basis for the removal of disabled parking bay
Under the Freedom of Information Act 2000, I am requesting the specific statutory provisions that Pembrokeshire County Council is relying upon to determine that the disabled resident parking bays are 'illegal', 'non-compliant with the Road Traffic Act', or cannot remain in place. For absolute clarity, this request is not for access to the councils legal advice, legal interpretation, or any legally privileged communications. I am requesting the legislation itself i.e. the statutory basis the Council asserts applies. Please provide: 1. The exact legislation, statutory instruments, regulations, or legal provisions that the Council states make the current resident disabled bays unlawful, non-compliant, or unable to remain. 2. Any published statutory or non-statutory guidance (e.g., Welsh Government, Department for Transport) that the Council relies upon when applying the above legislation and highlight which sections of these documents apply to these bays. 3. Any internal policy documents or criteria (non-legal advice) that set out how the Council determines the resident disabled bays are non-compliant and don't align with the Road Traffic Act. 4. The information, documents etc. you hold that determines Pembrokeshire can't apply the Road Traffic Act in the same way as Rhondda Cynon Taf and Neath Port Talbot Councils in respect of designating Disabled Resident Parking Bays.
